Christy Walsh Hunger Strike: Day 12

Christy Walsh on Day 12 of his hunger strike with a copy of an email he sent to Stormont First Minister Peter Robinson and his deputy, Martin McGuinness.

Dear Messrs Robinson & McGuinness

Today marks my 12th day on hunger-strike.

You will recall that both Mr Kevin Winters and I have said that we were unaware of what Karen Quinlivan, QC, had intended to do.   All of my lawyers had expressed that the evidence in my case was so overwhelming that it amounted to demonstrable innocence (or Category 1 by classification).   Ms Quinlivan signed and submitted her last skeleton argument to the court on 20th May 2012 and was consistent with all previous submissions made by my lawyers. Ms Quinlivan wrote:

However, taken together, they represent a formidable body of evidence which clearly demonstrates that the Applicant “should not have been convicted” and, in fact, was demonstrably innocent.

In a letter to the Bar Council Ms Quinlivan dated the 11 June 2012 Mr Quinlivan falsely claims that:

It is incorrect to state that I have ever represented to Mr Walsh that I thought his case was a Category 1 (demonstrably innocent) case or that it would be argued accordingly.

As can be seen Ms Quinlivan's contradictory statements are mutually exclusive.   Mr Winters has been quite explicit in his written opinion that any "down sizing or dilution" of the evidence in my case would involve "connivance" with David Ford's lawyers.  Mr Winters has put in writing that he did not instruct Ms Quinlivan to do what she did and that he had no prior warning that she was going to sabotage my case.

Evidence of serious professional misconduct between Mr Ford and the Barristers needs to be investigated.

Have either of you taken any steps to enquire into these serious claims?  If David Ford had clean hands he would have been eager to defend his reputation, as would the barristers.  If either the First or Deputy First Minister thought I was making false claims then you too would have spoken up by now.  Your failure to do so goes someway to confirming that you are both intent on trying to cover-up for your Justice Minister.

Yours Sincerely

Christy Walsh
